Las Cruces man William Magee allegedly urinated on sleeping 3-year-old — then shoved fleeing mother into a tree and struck officer

A 24-year-old New Mexico man allegedly urinated on a sleeping toddler, attacked the child’s mother and struck an arriving police officer, according to authorities.

William Joseph Magee, 24, was arrested after police responded to a home on Spitz Street in Las Cruces, New Mexico.

On September 13, officers responded to the Spitz Street residence, according to police.

The child’s mother told investigators she awoke inside the home to what sounded like “running water.”

She allegedly discovered Magee urinating on her sleeping 3-year-old son, police said.

She carried the toddler into the kitchen to clean him, according to investigators. Magee allegedly followed her, continued arguing and threw one of the child’s toys toward them, police said.

When the woman attempted to leave the residence with her children, Magee allegedly followed her outside, according to police.

She said Magee followed her outside, pushed her into a tree and threw her off a set of steps, investigators reported.

The child’s aunt reportedly witnessed part of the confrontation outside the home. Responding officers documented injuries on the mother that they said were consistent with the woman’s account.

Investigators later examined the toddler’s bed and reported that it was wet and smelled of urine.

Officers reported that Magee refused to come outside and became physical when they attempted to speak with him.

The suspect allegedly struck an officer before several officers tackled and handcuffed him, police said.

Officers on the scene also reported detecting a strong odor of an intoxicating beverage, according to authorities.

Magee was charged with child abuse, two counts of battery against a household member, resisting or obstructing, and battery on a peace officer, records show.

He was being held without bond, police said.
