The Indiana Supreme Court has ordered Jeffrey Weisheit, 50, to be executed before sunrise on Nov. 5.
The execution is scheduled to be carried out by lethal injection.
Weisheit has been on death row since he was sentenced in 2010.
He was condemned for the murders of five-year-old Caleb Lynch and eight-year-old Alyssa Lynch.
The killings took place in Evansville.
On April 9, 2010, Weisheit was caring for the two children while their mother worked an overnight shift, according to court records.
Firefighters responded to the burning home the next morning.
Inside the residence, responders found Alyssa’s body in a closet.
They found Caleb on a mattress.
The five-year-old boy was bound with duct tape.
A washcloth had been stuffed into Caleb’s mouth.
Investigators recovered railroad flares from the fire scene.
One railroad flare was found inside Caleb’s underwear.
Another flare was discovered beneath the boy’s body.

Both children died from smoke and soot inhalation.
Weisheit fled from the area.
Then, after a police pursuit, officers arrested him in Kentucky.
A jury convicted Weisheit of two counts of murder.
The jury also convicted him of felony arson resulting in serious bodily injury.
The children’s father had previously alleged that concerns regarding Weisheit’s treatment of the children had been reported to Child Protective Services prior to their deaths.
Weisheit has spent over a decade on death row following his sentencing.
But his attorneys have continued fighting the scheduled execution.
Defense attorneys argued that courts failed to adequately consider evidence showing Weisheit suffers from severe brain damage.
They also argued that the courts failed to adequately consider evidence of his mental illness.
And state attorneys maintain that Weisheit has exhausted all available appeals in his case.
State attorneys assert that Weisheit can now be lawfully executed.
Indiana has now ordered the lethal injection to proceed before sunrise on Nov. 5.
The date is set.
The order stands.
