A 21-year-old Wisconsin driver allegedly passed a semi truck at 72 mph before striking and killing a motorcyclist head-on, prosecutors said.
Caleb Mihalski, 21, is from Wisconsin, according to court records.
The crash killed 43-year-old motorcyclist Shawn Luther, authorities said.
In July 2023, Mihalski was allegedly following behind a semi on State Highway 22 in the town of Gillett, prosecutors said.
The motorist allegedly attempted to overtake the semi after the designated passing lane had ended, according to the criminal complaint.
Mihalski told investigators he noticed a faint light coming toward him and believed it was a distant vehicle with only one working headlight, the complaint states. Authorities said the oncoming vehicle was actually Luther’s motorcycle, according to police.
Dashcam footage from the semi allegedly captured Mihalski’s vehicle crossing into the opposing lane and striking the motorcycle head-on, prosecutors said.

Investigators said the vehicle was traveling approximately 72 mph shortly before the collision occurred, according to court records.
Police reported detecting no signs of impairment at the scene, court documents state. Subsequent laboratory testing, however, detected Delta-9-THC in Mihalski’s blood, according to the criminal complaint.
The collision took place in July 2023, and laboratory blood-test results came back that October, records show. Yet criminal charges were not filed until August 2026, roughly three years after the crash, according to court documents.
The criminal complaint reportedly offers no explanation for the nearly three-year delay in filing the case, records state.
Mihalski is now charged with homicide by vehicle with use of a controlled substance and second-degree recklessly endangering safety, prosecutors said.
The defendant has pleaded not guilty to the charges, and no trial date has been scheduled, according to court records.
Mihalski is scheduled to return to court on November 20, court documents state.
